Insurance Claims

Insurance Claims Disputes

Homeowner’s insurance policies cover numerous types of losses to your home including damage to the structure and personal property. Most insurance companies are in the business of charging and keeping premiums. They hope you never make a claim for the property insurance benefits that you pay for. When you make a claim, most insurance companies will vastly undervalue the claim or deny it altogether. We may be able to turn a claim denial in an accepted claim or significantly increase the value of claim, depending on the circumstances. Do not accept the first offer the insurance company makes on valuing the repairs to put your home into pre-loss condition.

If you find yourself with a claim being denied, delayed or undervalued, please give us a call. We may be able to help you fight the insurance company and receive the full the value of your claim.

We represent policyholders involved in any of the following disputes with their homeowners’ insurance company:

  • Hurricane claims
  • Roof damage
  • Water damage
  • Fire damage
  • Flood claims
  • Hail damage
  • Mold claims
If your claim has been denied, delayed, or undervalued, please give us a call at 407-843-9153 or contact us at [email protected] to set up a free insurance claim consultation.

Hurricane Claims:

If you have suffered damage because of Hurricane Irma and the insurance company has not visited your home or has not provided any payment, please contact us immediately for a Hurricane Irma consultation.

Claim Delays:

Insurance companies typically have 60 days from the date of loss to make a determination of coverage and issue payment for the undisputed amount of the claim. If your insurance company is delaying your claim, this may be a situation where we can assist you. Furthermore, if the insurance company is not providing any sort of reason for the delay, contact us immediately.

Undervalued/Partial Payment

You are entitled to receive insurance benefits to place your home into pre-loss condition. This accounts from everything such as painting the walls to kitchen cabinets/countertops. Furthermore, all items repaired need to match post reconstruction. For example, let’s say there is a homeowner’s insurance claim requiring kitchen repairs whereby the lower cabinets were completely damaged requiring replacement. If those cabinets are no longer available for purchase, the insurance company is required to provide enough funds to make all the cabinets (lower and upper) match.

Here’s another example, let’s say there is a water loss damaging continuous flooring (wood floors or carpet with no transitions between rooms) in large sections of the house. The insurance company needs to provide enough funds to make all these floors look the same if they cannot be matched when purchasing replacement flooring materials at retail. Certain types of flooring may likely never be matched due to color, lot, availability, etc.   Do not settle for a mismatch kitchen, room, repair, or reconstruction. Please contact us to discuss your options in disputing the insurance company.

You may also be entitled for reimbursement other items such additional living expenses and out of pocket expenses related to the loss. If you feel your claim has been undervalued by the insurance company, please give us a call.

  • When an insurance company offers to resolve a claim is not enough to cover reconstruction costs, CALL US
  • When an insurance company wants to pay minimally on valid out of pocket and additional expenses

Roof Claims

Some of the most common homeowner’s disputes involve your roof. Central Florida’s climate makes for severe weather that can cause severe damage to your roof for nearly six months. The most common damage to your roof that can occur is hail and wind. Hail damage can substantially shorten a shingle’s life expectancy and impair its ability to protect the home. If you do not repair hail damage shortly after the occurrence, it may lead to additional damage. Similarly, wind damage lifts, creases and eventually tears shingles off a roof. If wind damage shingles are not repaired shortly after the occurrence, interior damage may occur.

Depending on a variety of factors, roof and extent of damage, your insurance company may provide enough insurance benefits for a full roof replacement.

If your insurance company does not provide a full replacement and only wants to pay for a repair, please contact us for a free roof claim review. Certainly contact us under these circumstances if many of your neighbors are getting full roof replacements and your insurance company only wants to pay for a repair.

Water Damage Claims

Water damage are the most frequent claims that occur in the insurance world. A water damage claim is not a matter of if it will occur. Rather, it is a matter of when it will occur. Water damage claims can range from a pipe bursting to a water using device malfunction (washing machine, refrigerator, air conditioner over flow. These small items can cause significant damage (especially if these machines are located on the second floor of your home or the loss occurs when you are not in the house).

Insurance companies will undervalue the amount of money it takes to repair the home to pre-loss condition. If you have a water damage claim, please contact us for a free consultation to discuss whether your insurance company is undervaluing the claim.

Claim denials:

Stack of papers saying no

These situations arise when the insurance company simply denies coverage to an otherwise valid claim. Depending on the circumstances, we may be able to overturn the denial. Insurance companies typically deny claims on the following grounds: pre-existing damage, construction defects, and failure to comply to conditions under the policy. The insurance company must provide you with a reason for denying your claim. If they do not, they may be breaching the insurance policy themselves! Please give us a call to set up a free consultation if you have had a claim denied.
